Medical Malpractice in Buttocks Augmentation Cases

Errors in buttocks augmentation procedures can lead to serious complications. If you have suffered a complication after this type of procedure, you may have a valid medical malpractice claim. At DeFrancisco & Falgiatano Personal Injury Lawyers, our diligent Rochester medical malpractice attorneys can evaluate your case and determine a legal strategy accordingly.

Buttocks augmentation can be accomplished in a few different ways. A Brazilian butt lift takes place when a patient uses fat from one part of their body to be transplanted into their buttocks to increase the size, according to The American Society of Plastic Surgeons (ASPS). Butt implants, on the other hand, require a surgeon to insert silicone implants into the patient’s rear end. Women who are thin and do not have enough fat for liposuction are typically the candidates who go the implant route.

The ASPS reports that butt implants and lifts are the fastest-growing type of plastic surgery in the United States. In fact, butt implants increased by 18 percent between 2015 and 2016, while fat grafting procedures jumped 26 percent during the same time frame. In total, 20,673 butt augmentation procedures were performed in the country in 2017.

Unfortunately, in an effort to be more voluptuous, a number of people nationwide have turned to inexpensive and dangerous options. For example, hundreds of people received illegal buttock injections and experienced irreversible injuries and symptoms as a result. Last year, one Miami woman (not a licensed doctor) dubbed the “Toxic Tush” doctor was sentenced to 10 years behind bars for injecting women with a deadly mixture to enlarge their behinds, causing one woman to die.

In other cases, patients fail to vet doctors and surgical facilities properly. Doctors often cut corners in an effort to maximize profits or are simply not trained to perform these procedures. In addition, if a facility is not accredited as a surgical center, it may not have the equipment, tools, and staff needed to deal with medical emergencies.

Butt implants can be more risky than butt lift procedures. This is because there is a risk that the silicone may leak. One study found that complication rates associated with buttocks implant procedures are as high as 30 percent. Other risks associated with butt implants include but are not limited to:

  • Hemorrhaging or excessive bleeding;
  • Nerve damage;
  • Blood clots;
  • Permanent nerve damage;
  • Implant rupture.

Cosmetic surgeons, like all other types of surgeons, owe their patients a duty of care. When plastic surgeons fail to use that level of care, and a patient is injured, the surgeon can be liable for medical malpractice. In short, medical malpractice occurs when a medical professional fails to use the level of care that a reasonably competent medical professional would have used in the same or a similar situation.

When a patient is harmed due to a surgeon’s negligence, that patient can recover a variety of damages for his or her harm. Some common examples of these damages include medical bills, pain and suffering, lost wages, and compensation for any costs of future treatment.

If you suffered preventable harm due to a butt implant or butt lift surgery, you may be entitled to compensation for your harm.
