Plastic Surgeon Sued by 35 Patients for Malpractice

While many plastic surgery procedures seem routine, the reality is these are serious surgeries that carry a substantial risk of complication if the plastic surgeon fails to use the utmost care. A mistake during a plastic surgery procedure can result in a permanent deformity or even death. If you or your loved one has suffered preventable injury because of plastic surgeon’s negligence, let our seasoned Rochester medical malpractice attorneys help. At DeFrancisco & Falgiatano Personal Injury Lawyers, we know how to handle medical negligence cases.

An Omaha plastic surgeon is being sued for malpractice after patients allege the surgeon left their bodies deformed. There are currently 35 claims against the doctor, as well as the surgery center where the procedures took place. Specifically, the complaint claims that patients suffered physical and emotional harm such as disfigurement, painful scarring and nerve damage. In one specific case, a patient claimed she had a tummy tuck that went wrong, which left her with painful jagged scars across the abdomen.

Plastic Surgery Malpractice

While this case is from Omaha, the unfortunate reality is that plastic surgery malpractice is common in New York as well. If you or someone close to you has suffered preventable harm due to a plastic surgeon’s negligence, you may be able to recover damages through a malpractice claim. In order to win a medical malpractice case, you cannot simply show that you experienced an adverse medical malpractice. Rather, you must be able to demonstrate the following by a preponderance of the evidence:

  1. The plastic surgeon owed the patient a duty of care;
  2. The plastic surgeon breached the duty of care;
  3. The plastic surgeon’s breach was the direct cause of the patient’s injury;
  4. The patient suffered quantifiable harm as a result.

The duty of care refers to the level of care that a reasonably prudent plastic surgeon would have used under the same or similar circumstances. The breach of the standard of care is typically established by a medical expert who testifies that you did not receive adequate care in the situation.

Compensation for Plastic Surgery Errors

The consequences of a plastic surgery error can be extremely damaging. In some cases, patients who are disfigured have to have costly follow up surgeries to correct the error. Fortunately, New York law provides you the right to compensation if you were injured as a result of medical malpractice. Common examples of damages include medical bills, rehabilitation costs, pain and suffering, lost wages and compensation for any other losses arising from the malpractice.
